K-1 fiancé(e) and K-3 foreign national-spouse visa

The most common types of visas issued to family members are K visas. U.S. immigration law provides two methods for U.S. citizens to bring their spouses to the United States:
➤ K-1 fiancé(e) visa; the K-1 visa is used when the couple is engaged and will marry in the United States,
➤ K-3 alien spouse immigrant visa, which is a proven path to lawful permanent residence for your spouse.

 
K-1 visa: If you are planning to get married and would like to obtain a visa for your fiancé(e) (K-1 nonimmigrant status) to come to the U.S., we can help you apply for a K-1 visa so that you do not have to spend time apart before getting married in the U.S..

A U.S. citizen may sponsor a foreign fiancé(e) whom he/she has met at least once in person. A K-1 visa, also known as a "fiancé visa," leads to permanent resident status as long as the marriage takes place within 90 days of arrival in the U.S. K-1 visa holders are eligible for employment authorization. Dependent children of K-1 visa holders may accompany the visa holder under K-2 status.

Please note that you must either marry the U.S. citizen within 90 days of entry or depart the United States. After marrying the U.S. citizen who petitioned for you, you must file an application for permanent residence or adjustment of status. If your adjustment of status is approved, your status will be changed from K nonimmigrant to conditional permanent resident.

K-3 Visa: If you are already married to a U.S. citizen but are currently living outside the U.S., you must apply for K-3 nonimmigrant status so that you can come to the U.S. to live with your spouse.

K-3 Nonimmigrant Status (Spouse of a U.S. Citizen) You will be allowed to enter the United States temporarily while waiting for the approval of a family-based visa petition. Once the petition is approved, you will be eligible for lawful permanent residence and will need to file an Application for Permanent Residence or Adjustment of Status.

Eligible children of K-3 visa petitioners receive K-4 visas. Both K-3 and K-4 visas allow their recipients to remain in the United States while their immigrant visa petitions are pending approval by USCIS. The advantage of a K-3 or K-4 nonimmigrant visa is that you can work in the United States while you're waiting to adjust your status to lawful permanent resident. You will still need employment authorization.

Note: You do not need to apply for a work permit after you become a lawful permanent resident of the United States. You will receive a permanent resident card that allows you to live and work in the United States. Even if you are still waiting to become a permanent resident, your valid K-3 or K-4 nonimmigrant visa will allow you to travel in and out of the U.S.

- Current marriage certificate (if married / applying for K-3 visa)
- Any previous divorce documents issued by the court

- All previous divorce documents issued by the court
- All of your children's birth certificates - if their cases are being filed with yours
- All of your children's passports - (we charge an additional $100 per child)
